Fair Chance Act Changes

Summary
On September 1, 2023, the Office of Personnel Management (OPM) Director announced the release of final regulations to implement the Fair Chance to Compete for Jobs Act of 2019 (Fair Chance Act). This Act requires Agency human resources offices to issue and document written warnings, suspensions, and civil penalties to employees found to be in violation of 5 USC Ch. 92: Prohibition On Criminal History Inquiries Prior to Conditional Offer, and 5 CFR Part 920.202 Violations.
The Table Management System (TMGT), EmpowHR, and the Web-based Entry, Processing, Inquiry, and Correction System (EPIC Web) have been updated to comply with reporting requirements and to accurately document adverse actions for violations (written warnings, suspensions, and civil penalties) of the Fair Chance Act.

Implementation
TMGT, EmpowHR, and EPIC Web have been updated to accept and include the new NOACs, LACs, Remarks Codes, and information listed below.
- TMGT Table 101 and EmpowHR Tables to define Required and Optional fields.
- TMGT Table 052 and EmpowHR Tables to add the new remarks codes approved by OPM.
- TMGT Table 061 and EmpowHR Tables to add the new LACs approved by OPM.
- TMGT Table 062 and EmpowHR Tables to add the new NOACs approved by OPM.

To view and/or print this procedure, select HR and Payroll Clients from the MyNFC drop-down menu on the NFC Home page.
