Fair Chance Act Changes

On September 1, 2023, the Office of Personnel Management (OPM) Director announced the release of final regulations to implement the Fair Chance to Compete for Jobs Act of 2019 (Fair Chance Act). This Act requires Agency human resources offices to issue and document written warnings, suspensions, and civil penalties to employees found to be in violation of 5 USC Ch. 92: Prohibition On Criminal History Inquiries Prior to Conditional Offer, and 5 CFR Part 920.202 Violations.

The Table Management System (TMGT), EmpowHR, and the Web-based Entry, Processing, Inquiry, and Correction System (EPIC Web) have been updated to comply with reporting requirements and to accurately document adverse actions for violations (written warnings, suspensions, and civil penalties) of the Fair Chance Act.

Updated EmpowHR Tables to add the new Nature of Action Codes (NOAC), Legal Authority Codes (LAC), Remarks Codes, and Tables to define required and optional fields.


Updated to add NOAC 451 to the EPIC Web Main Menu. 


Updated the following TMGT Tables:

  • TMGT Table 101, Personnel Office Identifier Name and Address

  • TMGT Table 052, Remarks Code and Descriptions

  • TMGT Table 061, Nature of Action Conversion

  • TMGT Table 062, 3-Digit Nature of Action Code



TMGT, EmpowHR, and EPIC Web have been updated to accept and include the new NOACs, LACs, Remarks Codes, and information listed below.


The EPIC Web Procedure Manual, which is available online at the National Finance Center (NFC) web site, is being updated to include the information in this bulletin. To view and/or print this procedure, select HR and Payroll Clients from the MyNFC drop-down menu on the NFC Home page. At the HR and Payroll Clients page, select the System Documentation from the Publications Library Section, and then select the applicable system/aplication page to access the procedure manual.
